Mediation for retirement division issues that are not addressed in the Decree of Dissolution or Marital Settlement Agreement is available at an hourly rate. Absent a mediated agreement, we believe when a decree is silent as to a material provision in a QDRO that the court, or the parties, intended an “equitable” division of the retirement plan, and we will draft the QDRO accordingly.
